TERMS AND CONDITIONS

1. TERMS OF SALE
1.1. The Terms of Sale apply to the purchase of goods and services between the buyer (hereinafter referred to as the “Customer”) from the AdventureJack.ee online store and the company Adventure Jack OÜ, registration no. 16323739 (hereinafter referred to as “AdventureJack.ee”).
1.2. In addition to these terms, the legal relationships arising from the purchase of products from the AdventureJack.ee online store are governed by the Law of Obligations Act / Võlaõigusseadus (hereinafter referred to as “VÕS”), the Consumer Protection Act / Tarbijakaitseseadus (hereinafter referred to as “TKS”), and other applicable legislation of the Republic of Estonia.
1.3. AdventureJack.ee reserves the right to make changes to the Terms of Sale. Such changes will be reflected on the AdventureJack.ee website.


2. PRICING
2.1. All prices listed on the AdventureJack.ee online store are in euros and include a 22% value-added tax (VAT).
2.2. The price may be subject to an additional delivery fee depending on the chosen delivery method during the order process.
2.3. AdventureJack.ee reserves the right to make changes to the sale prices. Such changes will be reflected on the AdventureJack.ee website.
2.4. The online store has the right to withdraw from the sales contract and request the return of goods from the buyer if the price of the goods on the website has been listed significantly below the market price due to an error.


3. PLACING AN ORDER
3.1. Information about the product and its features is provided directly next to the product on the AdventureJack.ee online store.
3.2. To place an order, find the desired products and add them to your shopping cart. You can view the contents of your shopping cart by clicking on the shopping cart icon located in the top right corner of the website.
3.3. Before placing the order, please select the suitable delivery method for your order.
3.4. Before proceeding to payment, you must agree to and confirm the Terms of Sale and the Personal Data Processing Policy.
3.5. To complete the order, click the “Pay” button.
3.6. Payments are processed by Montonio Finance. Payment takes place outside the AdventureJack.ee online store in a secure environment – when paying via bank link, the payment will be processed in the respective bank’s secure environment.
3.7. The owner of the AdventureJack.ee online store is the data controller for personal data and will forward the necessary personal data to the authorized processor, Montonio Finance, for payment processing.
3.8. To pay for the products, select your preferred bank link and click “Submit Order.”
3.9. You will then be redirected to the selected internet bank for payment. An order confirmation and invoice copy will be sent to your email address.
3.10. The products will be prepared and shipped to you after the invoice has been paid.


4. EFFECTIVENESS OF THE SALE
4.1. The Customer commits to the order and payment by clicking the “Place Order” button.
4.2. The sales contract enters into force when the total order amount is received on the bank account of Adventure Jack OÜ.
4.3. If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the customer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded without delay, but no later than 14 days from the date of notification.


5. DELIVERY
5.1. The Customer can choose between the following delivery methods: “Delivery by courier” or “Pick up”.
5.2. After the sales contract enters into force, AdventureJack.ee will assemble the order and hand it over to the company’s logistics partners for delivery or inform the customer about the order completion and the option to pick it up in person.
5.3. Order assembly and handover to logistics partners are carried out on working days, from 09:00 to 17:00.
5.4. The order will reach the customer’s selected address within 2-4 working days.
5.5. Upon prior agreement, the customer can pick up the order in person at the AdventureJack.ee pickup point. Goods are available for pickup on working days, from 09:00 to 17:00. We are flexible regarding pickup times, if possible.
5.6. To ensure prompt delivery, it is important to provide accurate and valid delivery information when placing the order.
5.7. AdventureJack.ee is not responsible for delays in delivery if the goods were handed over to the logistics partners on time, but the delay in delivery is due to circumstances that AdventureJack.ee could not influence or foresee.


6. RETURNING
6.1. Products purchased from the AdventureJack.ee online store are subject to a 14-day right of return, starting from the date the goods are received. If the product ordered from the online store does not meet the Customer’s expectations, the Customer may return it to AdventureJack.ee without providing any reasons.
6.2. The right of withdrawal does not apply if the buyer is a legal entity.
6.3. To return the product, a written notice of withdrawal must be sent to the address info@adventurejack.ee. AdventureJack.ee recommends that the Customer include the reason for withdrawal in the notice.
6.4. In order to exercise the 14-day right of return, the ordered goods must not be used in any way other than necessary to verify the nature, properties, and functionality of the goods, as permitted when testing the product in a physical store.
6.5. Returned products must be unused, in their original packaging, undamaged, and retain their commercial appearance.
6.6. When returning the goods, the Customer is required to deliver the goods to AdventureJack.ee either personally or via another transport service provider within 14 days from the date the notice of withdrawal and intention to return the product reaches AdventureJack.ee.
6.7. The Customer shall bear the costs related to the return of the goods.
6.8. In the event of a return, the amount paid for the product (excluding shipping costs) will be refunded to the bank account provided by the Customer within 30 days from the day the goods were returned to AdventureJack.ee.
6.9. The online store may refuse to make a refund until the item that is the subject of the contract has been returned or until the buyer has provided evidence that the item has been sent back, whichever occurs first.
6.10. The 14-day right of return does not apply to goods if:
▪ it has been used;
▪ it has been assembled and/or tested on the roof of a vehicle (in the case of a roof tent);
▪ the defect was caused by improper use of the product (failure to follow the instructions);
▪ the product has mechanical damage or is broken (e.g., due to a fall);
▪ the product has normal wear and tear or defects that do not affect the product’s value or usability;
▪ the device has been repaired by an unauthorized service provider.


7. LIABILITY AND FORCE MAJEURE
7.1. The AdventureJack.ee online store shall be liable to the Customer, and the Customer shall be liable to the AdventureJack.ee online store, for any damage caused to the other party due to a breach of these terms and conditions, in the cases and to the extent provided by the laws of the Republic of Estonia.
7.2. AdventureJack.ee shall not be liable for any damage caused to the Customer or for any delay in the delivery of goods, if such damage or delay was caused by circumstances beyond the control of AdventureJack.ee and which could not have been foreseen (force majeure).


8. SUBMITTING CLAIMS
8.1. AdventureJack.ee online store is liable for any non-conformity or defect in the goods sold to the Customer that existed at the time of delivery and which becomes apparent within two years from the date of delivery.
8.2. The online store is not liable for any defects that have arisen after the goods have been handed over to the Customer.
8.3. In case a defect becomes apparent, the Customer must contact AdventureJack.ee within two months and present the invoice or order confirmation as proof of purchase. Upon discovering a defect, the Customer is advised to discontinue use of the product immediately.
8.4. AdventureJack.ee is not liable for defects caused by the Customer, including improper storage, misuse, incorrect assembly or installation, accidents, or overuse, nor for normal wear and tear resulting from regular use.
8.5. If the Seller has reason to doubt whether the defect was caused by a manufacturing fault or the Customer’s actions, an expert assessment will be conducted to determine the cause.
8.6. During the first six months after purchase, the burden of proof regarding the cause of the defect lies with AdventureJack.ee.
8.7. After six months, the party responsible for the defect must bear the costs of the expert assessment.
8.8. In case of non-conformity or defects, a claim must be submitted via email to info@adventurejack.ee. The claim must include the Customer’s name and contact details, the date of submission, a description of the defect, and the request made to AdventureJack.ee. Reference must be made to the document proving the transaction or warranty, or a copy of such document must be attached.
8.9. AdventureJack.ee will review and respond to the Customer’s complaint in writing or in a format allowing written reproduction as soon as possible, but no later than 15 days after receiving the claim.
8.10. If the goods purchased from the online store have defects for which the online store is liable, the store will repair or replace the defective goods. If repair or replacement is not possible, the store will refund all fees paid under the sales contract.
8.11. The Customer has the right to request a reduction in the purchase price or to terminate the contract and demand a full refund if AdventureJack.ee is unable to repair or replace the goods, if repair or replacement fails, or if the store has not remedied the defect within a reasonable time.
8.12. A claim for non-conformity or defect must be submitted as soon as the issue becomes apparent, but no later than two months from the date of discovery.

9. WARRANTY PERIOD AND CONDITIONS
9.1. The AdventureJack.ee online store facilitates the manufacturer’s warranty for the products sold. The manufacturer’s warranty provided by Adventure Kings is valid for one (1) year.
9.2. The warranty period begins on the date indicated on the delivery document.
9.3. The seller is obligated, during the warranty period, to rectify defects as defined in the manufacturer’s warranty terms, including:
• Any design or manufacturing defects that cause the product to not conform to its description.
• Any design or manufacturing defects that render the product unfit for its intended use.
The warranty does not cover:
• Damage caused by incorrect assembly or installation, improper use, or unauthorized modifications.
• The cost of removing or reinstalling the product (e.g., in the case of rooftop tents).
• Shipping costs related to the fulfillment of warranty obligations.
• Damage incurred during transportation.
• Any losses directly or indirectly caused by the inability to use the product due to a manufacturing defect (e.g., cancelled overland trips due to a rooftop tent issue).
• Damage caused by insects or rodents.
• Damage resulting from accidents.
• Wear and tear resulting from normal use of the product.


10. CUSTOMERS RIGHT TO REFER TO THE CONSUMER COMPLAINTS COMMISSION
10.1. If the AdventureJack.ee online store has refused to resolve the Customer’s complaint or the Customer does not agree with the solution offered by AdventureJack.ee and believes that their rights have been violated or their interests harmed, the Customer may submit a complaint to the Consumer Disputes Committee via the Consumer Protection (Tarbijakaitseamet) and Technical Regulatory Authority or to a court. The Customer may file the complaint personally or through a representative. The contact details of the Consumer Disputes Committee are available on the website of the Consumer Protection and Technical Regulatory Authority at www.tarbijakaitse.ee. For resolving disputes arising within EU member states, the Customer may contact the European Consumer Centre at www.consumer.ee.


PERSONAL DATA PROCESSING

1. The data controller for the personal data of the buyer (hereinafter referred to as the “Customer”) of the AdventureJack.ee online store is AdventureJack.ee, operated by Adventure Jack OÜ, with the registration number 16323739, located at Heinavälja 4-80, 10617, Tallinn, Republic of Estonia.
2. AdventureJack.ee processes the personal data provided by the Customer in accordance with the requirements established by the Personal Data Protection Act. The personal data to be processed includes information requested from the Customer during the registration of the online store account and/or when placing an Order (first and last name, address, phone number, email address, shopping cart content, purchase history, bank account number).
3. AdventureJack.ee processes the Customer’s personal data for the purpose of fulfilling Orders (including sending Order-related notifications), delivering products, and preparing and sending offers and news for regular customers.
4. AdventureJack.ee does not disclose the Customer’s personal data to third parties, except to the courier service provider to the extent necessary for the delivery of Products to the Customer, and solely for the purpose of Order fulfillment. Authorized processors ensure the same level of data protection as AdventureJack.ee.
5. Data on the purchase history (purchase date, goods, quantity, customer details) is used to compile an overview of purchased goods and services, analyze customer preferences, and, among other purposes, for resolving consumer disputes.
6. The bank account number is used for processing refund payments to the customer.
7. Personal data such as email address, phone number, and customer name are processed for the purpose of resolving issues related to the provision of goods and services (customer support). The email address is used for sending invoices, and the phone number is used to notify the customer of the delivery time.
8. The IP address or other network identifiers of the user of the AdventureJack.ee online store are processed for the purpose of providing the online store as an information society service and for generating web usage statistics.
9. If the accounting for the AdventureJack.ee online store is carried out by a service provider, personal data will be transmitted to the service provider for the purpose of performing accounting operations.
10. Personal data may be transferred to information technology service providers if necessary to ensure the functionality of the AdventureJack.ee online store or for data hosting purposes.
11. The Customer has the right to access their personal data at any time and to request the modification or deletion of such data, unless otherwise provided by law, by submitting a request to AdventureJack.ee at the email address info@adventurejack.ee.
12. If the Customer has expressed the wish and given consent to receive newsletters and/or personalized offers from the AdventureJack.ee online store, the Customer has the right to withdraw this consent at any time by sending a corresponding request to the email address info@adventurejack.ee.
13. The Customer has the right to request the transfer of their personal data to another data controller at any time by submitting a digitally signed request to AdventureJack.ee at the email address info@adventurejack.ee. AdventureJack.ee has the right to refuse the direct transfer of personal data to another data controller if, in AdventureJack.ee’s opinion, the transfer to a third party is not secure.
14. If the Customer believes that their rights are being violated in the processing of personal data within the AdventureJack.ee online store, the Customer has the right to file a complaint with the Data Protection Inspectorate (Andmekaitse Inspektsioon) and/or take the matter to court.
